Twitch Europe Employment Candidate Privacy Notice

Twitch values your privacy and wants you to be familiar with how we collect, use, and disclose information from and about you. This Privacy Notice describes our privacy policy for our candidates.

Who This Privacy Notice Covers

This Privacy Notice covers all candidates for employment directly by Twitch Interactive, Inc. and its affiliated companies in the European Economic Area (the “EEA) and the United Kingdom (“Twitch” and “we”). It also applies anywhere it is linked.

This Privacy Notice does not cover candidates for employment by any company other than Twitch. Information collected on behalf of Twitch’s parent company, Amazon.com or its non-Twitch affiliates or subsidiaries (collectively, “Amazon”) is subject to Amazon’s Global Candidate Privacy Notice and Data Policy, which we encourage you to review for information about how Amazon collects and uses personal data of employment candidates.

Personal Data Twitch Collects About You

We obtain information about you through the means discussed below when you are an employment candidate of Twitch. Twitch controls what personal data is collected and how it is used. In some countries, this role is referred to as the “controller.” To get the physical address of the company you are applying to, please contact the Candidate Privacy Team.

We may collect and use the following types of personal data about you (some or all may apply to you):

  • Identification data
  • Contact and location information
  • Demographic data
  • Characteristics of protected classifications under applicable law (only where you choose to provide such information or we are required to collect it by law)
  • Data regarding responses to screening questions
  • Background check information
  • Education information
  • Professional and employment-related information
  • Data pertaining to work preferences and abilities
  • Resume data
  • Information on disability status (only where required by law)
  • Job interview notes
  • Assessment results and performance information
  • Travel-related records
  • Expense data
  • Cookies data

Much of the personal data we process is obtained from you, but we also obtain personal data about you in the course of the application process (for example, during interviews or via job assessments). Other data types may be obtained indirectly, such as from publicly available sources, and third parties, including, for example, from professional networks and recruitment agencies.

How Twitch Uses Personal Data

Generally, the personal data we collect helps us manage your recruiting and hiring process, conduct Twitch’s businesses, and comply with Twitch’s legal obligations. Please note that we need certain types of information in order to facilitate these activities. If you do not provide us with such personal data, or ask us to delete it, it may impact our ability to evaluate your candidacy or employment by Twitch.

Collecting and using your data enables us to administer the recruiting process, including setting up an electronic job applicant HR file; managing your application; conducting assessments; organizing interviews, including arranging or reimbursing for your travel; providing accommodations; processing interview feedback; on-boarding; and conducting background checks and screening. Your data may also be used to notify you about other Twitch job opportunities. We may process your personal data to meet recordkeeping and internal and external reporting responsibilities. Your information may also be used in investigations or as needed in legal proceedings.

Typically, we do not use your personal data for so-called “automated decision-making”. We will inform you separately if your personal data is ever made subject to automated decision-making.

In the event of an unsuccessful application, most candidates want us to retain the data they provided so that we can contact them about other interesting job opportunities at Twitch. To make this possible, we ask you at the point of your first application whether, in the event of an unsuccessful application, you want us to keep the personal data that you provide to us for a period of time and make it available to recruiters within Twitch. If you consent, our recruiters will be able to consider and contact you for other Twitch job opportunities. You can revoke your consent at any time by changing the consent settings in your candidate profile.

When Twitch Discloses Personal Data

We disclose personal data as described below:

  • We share personal data within Twitch only where lawful to do so and for legitimate purposes. We take appropriate steps to ensure that people who receive your information are bound to maintain the security and confidentiality of the data. If your application is unsuccessful and you have given us consent to retain your data, we will also share your personal data with recruiters within the Amazon group.
  • We share personal data with Amazon where lawful to do so and for legitimate purposes. Information we make available to Amazon becomes subject to Amazon’s Global Candidate Privacy Notice and Data Policy.
  • We share personal data with service providers, including work agencies, that perform services for or on our behalf in connection with the application and recruitment process.
  • We may share personal data if we believe in good faith that such disclosure is necessary to comply with applicable law (for example, in the country of your residence), or respond to a court order, judicial or other government request, subpoena, or warrant in the manner legally required.
  • We reserve the right to disclose information that we believe, in good faith, is appropriate or necessary to protect Twitch from potential liability or from fraudulent, abusive, or unlawful conduct or practices; investigate and defend ourselves against third-party claims, or allegations; protect Twitch against security incidents and misuse; or protect the rights, property, or safety of Twitch, our employees, our users, or others.
  • We may share your personal data with third parties who may act as controllers in their own right and are not governed by this Privacy Notice in certain circumstances, where lawful to do so and for legitimate purposes. Such third parties may include:
    • HR service providers
    • Governmental organizations or agencies, including law enforcement
    • External advisors (such as legal advisors, accountants)
  • We also reserve the right to transfer or assign personal data in the event that Twitch, or some or all assets related to the Twitch Services, are acquired by or merged with a third-party entity or in connection with a contemplated change of ownership transaction as part of such merger, acquisition, sale, or other change of control event, including in the course of diligence.

Twitch will provide notice before sharing personal data other than as set out in this Privacy Notice, except where such notice is prohibited or not required by law.

International Data Transfers

On some occasions, for example, when we or Amazon, or one of our or Amazon’s service providers, have employees or operate in other countries, we will transfer your personal data to countries outside the country/region where you work and outside the EEA or UK. For all such transfers, we provide appropriate safeguards through EU Standard Contractual Clauses based on the European Commission’s model clauses. Data Security

We use a variety of managerial, technical, and physical measures to protect the integrity and security of your information, including measures to protect against unlawful or unauthorized processing and accidental loss or damage. These measures may vary based on the sensitivity of your information. However, no security precautions or systems can be completely secure. We cannot ensure or warrant the security of any information you transmit to Twitch, and you do so at your own risk. We cannot guarantee that such information may not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards.

Retention of Your Data

If your application for employment is successful and you commence employment with Twitch, your personal data will be retained and processed in accordance with our internal policies and practices applicable to data concerning personnel.

If your application for employment is not successful and you have not provided consent, we will generally keep your personal data beyond the end of the application process for a limited time specific to the country where the job is located for the purposes of (i) contacting you for future job vacancies, (ii) to meet record keeping requirements, and (iii) for potential use in legal proceedings. We will keep assessment data up to 3 years and master candidate data up to 5 years to avoid unreasonable duplications of recruiting efforts.

If your application for employment is not successful and you have provided consent, we will keep your data for up to 5 years for the purpose of considering and contacting you for future job opportunities.

Rights and Choices Regarding Your Information

You have the right to request access to, correction, or deletion of your personal data, to ask for data portability and the restriction of processing, as well as – depending on the laws of your country – the right to define instructions on your personal data after your death. You are also entitled to object to the processing of your personal data in certain instances. When we process your personal data based on your consent, you may withdraw your consent for the future at any time. To make a data subject request, please contact the Candidate Privacy Team.
